Incorrect Print?

I have been printing for a company (sells Retail) for a few yrs now and have not had any problems, until now. I printed a job of 175 shirts and somehow the art got reduces by 2" (Full Front Print). The customer ask me to replace the shirts and he would keep them. I told him I would replace them but that if I did then they belong to me to do what I wish (including sell them). He was furious and said I could not sell his logo that it was Trademarked. He wants to have me pay for shirts and he keep them and I am sure he would sell them. Who is right. Chime in please.

i agree that if he wants them reprinted that you should be getting the shirts back.

I do not agree that you can sell them. They are damaged goods, and I'd tell your customer they'll be used for samples or rags.

Can't sell someone else's product and not expect to pay (them) even if you printed it. You can require to get them back and trash them or use as test prints. at this point, me will want confirmation that they were destroyed or used as test prints. You could cut the print in the center. of all and show him the box.

He also can't expect to "keep" the incorrect shirts for free either. Thats stupid.

yup. just like Dan Said.

You can also tell him he can keep the shirts for the cost of the shirt + your time, that way you aren't losing your butt, and he is getting a "sell-able", albeit damaged shirt, for cheap.

Also not to steal this thread, but what would you all do if a client returns a one color print, because there is a pinhole (from lint), in several shirts?

Either touch up the pinhole (if possible), or re-print.

Ditto to the above on not being able to sell the rejects, try selling them to him at a good discount, or you can always tell him if he won't take them, you're going to donate them to the local homeless shelter......  ;)  ;D

Late to the party, but yes on all points:

Customer keeps, customer pays a reasonable price (win-win as you cut your losses)

No sales or even contributions of messed up shirts - that's just poor business. I have made the exception of foreign disaster contributions after a few years in storage, but never on a retail line.

Yes, a defect is a defect, and a dust bunny void is a defect and thew shirts should have been touched up before delivery. btw one man's pinhole, is another's gaping white spot!
This is one of the reasons that I fold each shirt as a secondary quality check.
That rug really tied the room together, did it not?

yup, people don't get this for some reason.  this would happen at my sister's restaurant all the time.  people eat their entire meal and then complain it wasn't good and get the whole thing comped.  This is probably what the guy is doing.  Here are our options

1. Replace the goods with the bad ones being returned

2. Replace the goods and the customer keeps the others at a discounted rate.

3. Refund of the order and the customer returns the shirts.

4. Customer just keeps those shirts at a discount

You can't buy a (defective) power tool at Home Depot and then go back in and expect them to refund your money if you don't bring the old tool back in.

A couple of things:
I learned years ago that shirt speculators will definitely try to reverse their misfortune and blanme it on the printer. Thing is, you can't give them anny ammo, no justification. Unfortunately, your size mistake opened the door.

Now, unless they were date specific, I believe that you are within your rights to replace rather than refund.\, if that's better for you.

May be a good time to shoot for a compromise.

Honestly, we have had customers who firmly 'renegotiated' after the fact.  Note the past tense.
