Would something like this be copyrighted?

I'm talking to a customer that has a design for his cross country team that is a variation on something like that link.
Could that be copyrighted? I think that I have seen it on a bunch of places.
It does not look like that, but it has two "C" and an arrow in the middle of an oval.

Thanks

Since there are a million variations of this already out there it may be tough yet is possible. Best option is to get with a copyright lawyer and search to make sure it wouldn't infringe on something already copyrighted.

I know that I ran it twenty years ago already for a high school team.
I honestly believe that it is just generic cross country stuff.

I seriously doubt you'd have a problem with that.  You'd also be surprised at what isn't copyrighted.  For example, the Braves tomahawk.  Look at anything printed or digital, there are no marks next to it.  I have a friend that was making bird houses shaped like them and he fought them and won.

Uh-oh, I'm in trouble. We've printed a few hundred million of those for some close friends :o

You folks better brush up on your law.....A copyright is in effect as soon as something is created......

As far as the Braves Tomahawk the issue there is Trademark....And it may be that the tomahawk is in such common use it can not be trademarked.....

actually, that isn't correct.  you have to prove it was created first.  that is the rub.  also, you have to prove YOU were the first to create it.

kinda like the family that wanted to copyright the Happy Birthday song.  They couldn't prove their grandfather wrote it, he just told them all that he did.

I believe that if you use that song in your next film, or other commercial enterprise that gets noticed, you will be speaking to lawyers from Time Warner AOL, or whatever the company is now.
They do own the rights to the common song.

Probably why they sing other stuff at Benihana and similar restaurants.

So, how about winged feet, or basketballs flying through hoops? Man, are we screwed...

I guess it was the Hokey Pokey song.  I saw a special about it like 15 years ago, well before the advent of wiki or snopes.

I guess there was a copyright feud over it or something.

Interestingly enough the roller rink I would go to parties at as a kid and do the hokey
pokey had poorly drawn Disney and Warner Brothers characters on all the walls.

Anyone ever looked into IP insurance?

I asked my insurance guy but he's pretty flaky and never got back to me.

That is just a generic universal mark for cross country. Would totally not sweat it.

redraw it change the font slightly, the arrowhead or the feathers slightly, keep your sketches and the copyright is YOURS. i I drew these after reading your post, they are yours if you want to use them. PM me I will send you the CDR files if you want but because I drew them from scratch these specific designs are mine ;)
