Wow!  These are so obvious, I can't see how any lawyer can argue the point but they do.

This has been happening for a long time. There is even a whole website dedicated to this:

My Secondary company had designs stolen by some other companies, and we are in lawsuits with them as well.

The tactic companies like Zara use are, we are a huge company, and for these little puny artists to hire a lawyer, we'll run circles around them.

Also, Companies like Zara are buying from companies that are shell companies, that are bootlegging designs.

I print balloons for one of the artist listed in the article. He is a good customer and great guy. I hate to see this happen.

Ah the classic David & Goliath but in reverse. Deep pockets can make their own rules  and  will always use their size and weight to legitimate  those self serving rules against the Davids of the world. 
If the article linked is accurate the theft is as obvious as it appears Zara should be crushed like a bug however their size and likely experience in this kind of theft will steel them from any swift justice.

Reading the company's reply it is obvious the BS trail will be long and deep and designed to wear down the limited resources of the talent  they steal from.

And it's not just artists getting screwed, but printers too. We had a large contract customer last year stop paying us, to the tune of 12K, and had that same attitude. But, a judge found otherwise, and has increased their debt to 28K, and we are a secured creditor, as opposed to unsecured. Then, a new customer, a much larger promotional company, and wants to do a run of 4400 shirts for a local University, and they will get us permission to use the art, that we've already printed and not been paid for. Hilarious... so, I looked up the school and on their website, they state that to do business with them, a vendor has to be stable, and of the  highest character. What a load of BS, when I called them to try to take the work, and explain what they have done in the past to other small vendors, and they said that they would take it under advisement. In other words, despite their rhetoric, they're crap too...

this was an email from a broker, that i got forwarded on a chain, requesting us to print some shirts for a famous rapper. yes i will, and no i don't take iou's.
